Selvbestemmelse Og så blev de mange, lange og svære forklaringer på de forskellige dele, som juryen skulle tage stilling til indledt med Raji Sourani, direktør for det palæstinensiske center for menneskerettigheder i Gaza. Sourani, der er menneskerettighedsadvokat, talte om palæstinensernes ret til selvbestemmelse. I artikel 1, både i den Internationale konvention om civile og politiske rettigheder, og den Internationale konvention om økonomiske, sociale og kulturelle rettigheder står der at: Alle folk har ret til selvbestemmelse. På grund af denne ret kan de frit bestemme deres økonomiske, sociale og kulturelle udvikling. Denne ret er erga omnes altså en ret, der binder alle stater, hvad enten man er medunderskriver af konventionerne eller ej, sagde Sourani på tribunalet. Palæstinensernes ret til selvbestemmelse er uomtvistelig. Den er blevet bekræftet i utallige FN-resolutioner og af den Internationale Domstol i Haag. Men, situationen i Palæstina er defineret af den systematiske fornægtelse af denne ret, sagde han. Sourani talte om betydningen af fragmentationen af Palæstina, om Gaza, hvor 80 procent af befolkningen, på grund af Israels illegale lukning af grænseovergange, er afhængig af international hjælp, hvor 60 procent lider under fattigdom og 40 procent er arbejdsløse. Israels kontrol har nu oven i købet nået et punkt, hvor de føler sig selvsikre nok til offentligt at udtale, hvor mange kalorier en person i Gaza har adgang til at indtage dagligt, sagde Raji Sourani vredt. Angående retsvæsenet fortalte han om de tusinder af sager, som centeret for menneskerettigheder har bragt for retten og at 99,5 procent af disse sager aldrig var blevet hørt.
